equitable distribution

equitable distribution
equitable distribution n: the distribution of marital assets by a court in a divorce action in accordance with statutory guidelines that are designed to produce a fair but not necessarily equal division of the property

Merriam-Webster’s Dictionary of Law. . 1996.

equitable distribution
A method of distributing property fairly but not necessarily equally among interested parties, particularly between a husband and wife after a divorce.

The Essential Law Dictionary. — Sphinx Publishing, An imprint of Sourcebooks, Inc. . 2008.

equitable distribution
A legal principle followed by most states, under which assets and earnings acquired during marriage are divided equitably (fairly) at divorce. Some states start with the presumption that equitable means equal, but the court is not required to divide assets equally. In some states, a spouse who is guilty of "fault" actions like adultery may receive less than an equal share, and other factors may contribute to an unequal distribution that is still considered equitable and fair. Compare: community property

equitable distribution
n. In divorce law, a remedy under which the court makes a fair (not necessarily equal) distribution of the marital assets. This is the alternative to the community property (equal) approach followed in some jurisdictions.
